Penalties and market surveillance under the CRA

The CRA is enforced by national market surveillance authorities. Fines are linked to worldwide annual turnover.

The maximum amounts

Up to €15 million or 2.5% of worldwide annual turnover for breaches of the essential requirements and the core manufacturer obligations; up to €10 million or 2% for other obligations; up to €5 million or 1% for incorrect or incomplete information to authorities. The higher amount applies in each case.

Relief for small companies

Micro and small enterprises are not fined for missing the 24-hour deadline for the early warning; all other obligations apply to them as well.

What authorities can order

Request documents, require corrective action, restrict making available, withdraw or recall products. Well-organised technical documentation is the best preparation.
