normakte / Terms
The key sentence is in section 3: hosting digital instructions does not fulfil your ten-year obligation. It only makes it more convenient.
normakte is a software offering of ITG Suisse Sagl, Corso Elvezia 25, 6900 Lugano, Switzerland (UID CHE-388.820.498). It helps manufacturers compile and maintain the documentation required by Regulation (EU) 2023/1230 and Regulation (EU) 2024/2847. normakte is aimed at businesses.
normakte is a drafting and calculation aid. It is expressly not: legal advice; a conformity assessment within the meaning of Art. 25 of Regulation (EU) 2023/1230 or Art. 32 of Regulation (EU) 2024/2847; a notified body or an authorised representative; nor a warranty that a document produced with it meets the requirements. The text published in the Official Journal of the European Union always prevails; drafts must be checked against it before use.
Several obligations of both regulations run for ten years or more: keeping the technical documentation and the EU declaration of conformity (Art. 10(3) of Regulation (EU) 2023/1230; Art. 13(13) of Regulation (EU) 2024/2847: ten years or the support period, whichever is longer); the online availability of digitally provided instructions (Art. 10(7)(c)) and of a digital declaration (Art. 10(8)); the availability of security updates provided (Art. 13(9) CRA). These obligations rest with the manufacturer and do not pass to normakte. A document hosted with normakte does not fulfil them on your behalf. Hosting is a convenience feature with monthly notice, and a service cancellable monthly cannot, by its very term, carry a ten-year obligation.
Full export, at any time. All documents, requirement lines, evidence and timestamps in open formats (PDF, Word, CSV, JSON), at no surcharge and without waiting. Export after cancellation. Export remains available for 90 days after the contract ends; data are then deleted. Advance notice. If a hosting feature is discontinued, we give at least six months notice and provide the address mapping table. No address lock-in. The address scheme is documented and reproducible on your own domain.
Printing a QR code on a nameplate ties you, for the life of the machine, to the address behind it, and a nameplate cannot be changed afterwards. We therefore recommend pointing the printed code to an address on your own domain, redirected internally to normakte. Control over the ten years then stays with you, regardless of whether normakte still exists in ten years.
Technical documentation contains manufacturing drawings, information on safety-relevant software and the software bill of materials (SBOM). Under recital 77 of Regulation (EU) 2024/2847, the SBOM need not be made public. normakte makes no customer content publicly accessible and does not pass it to third parties, except where necessary for providing the service or where legally required.
Free tools are provided without any availability commitment. Without a paid plan, one file can be kept free of charge for testing until and including 20 January 2027; after that it remains readable and exportable until it is deleted. Publishing on the nameplate requires a paid plan. Paid plans are cancellable monthly. As the provider is established in Switzerland, for supplies to EU businesses VAT is due by the recipient under the reverse-charge mechanism, provided a valid VAT number is given, which must be stated when ordering. Billing is monthly in advance, via the payment provider Stripe. Cancellation is possible at any time for the end of the current billing month, without reason and without notice period.
Liability follows the statutory provisions. For slight negligence we are liable only for breach of essential contractual obligations and limited to the foreseeable, contract-typical damage. Liability for intent, gross negligence and for injury to life, body or health is not excluded.
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Lugano, Switzerland. normakte is aimed exclusively at businesses; mandatory consumer-protection provisions therefore do not apply.
