EU declaration of conformity: the mandatory particulars

A finished, ready-to-use machine carries the CE marking and an EU declaration of conformity. Here is what that declaration must contain — under Annex V Part A of the Machinery Regulation.

The EU declaration of conformity is the document by which the manufacturer, under its sole responsibility, states that the machine meets the applicable Union acts. Its content is set by Annex V Part A; it is not a free-form formality.

Art. 21, Annex V Part A

The mandatory particulars (Annex V Part A)

  1. designation of the machinery (model, type, serial number);
  2. name and address of the manufacturer and, where applicable, the authorised representative;
  3. a statement that the declaration is issued under the sole responsibility of the manufacturer;
  4. object of the declaration, identifying the machine traceably;
  5. a statement of conformity with the applicable Union acts;
  6. references to the harmonised standards or other technical specifications applied;
  7. where applicable, the notified body, the procedure followed and the certificate;
  8. place and date of issue;
  9. signature (name and function of the signatory).

The mistake that shows up in an inspection

Naming a product family instead of the specific machine, or writing "applicable standards applied" without citing the references, makes the declaration insufficient. Traceability (particular 1/4) and the standards references (particular 6) are exactly what market surveillance checks.

And if the machine is connected

If the machine is also a product with digital elements, the Cyber Resilience Act applies on top — but not as a second declaration:

Where the product is covered by several Union acts requiring an EU declaration of conformity, a single declaration is drawn up for all those acts.
