One declaration, several acts

Almost every machine falls under more than one act. Yet only one document is issued — and that is not a simplification, it is a requirement.

A connected machine with electrical equipment can fall simultaneously under the Machinery Regulation, the EMC Directive, the Low Voltage Directive and, from 2027, the Cyber Resilience Act. Four acts — and one declaration.

Where the product is covered by several Union acts requiring an EU declaration of conformity, a single declaration is drawn up for all those acts — with the particulars of the acts concerned, including the references of their publication.

Art. 21(3) Regulation (EU) 2023/1230 · Art. 28(3) Regulation (EU) 2024/2847

What the list looks like

Point 6 of Annex V Part A names all applicable acts, each with its reference in the Official Journal. By way of example:

ActReference
Regulation (EU) 2023/1230 on machineryOJ L 165, 29.6.2023, p. 1
Regulation (EU) 2024/2847 (cyber resilience)OJ L, 2024/2847, 20.11.2024
Directive 2014/30/EU (EMC)OJ L 96, 29.3.2014, p. 79
Directive 2011/65/EU (RoHS)OJ L 174, 1.7.2011, p. 88

The standards applied are listed under point 7 — also with the date of their publication in the Official Journal and, where partially applied, with the applied parts.

Two declarations are a mistake, not caution

Whoever issues one declaration per act does not meet Art. 21(3). And in practice a second problem arises: two documents must be updated twice, and the versions drift apart. Art. 21(2) requires keeping the declaration up to date continuously. With one document that is one task; with four it is four.

What the Cyber Resilience Act adds

Its Annex V requires essentially the same particulars. The novelty is above all that it allows a simplified version: a short form referring to the regulation and the exact internet address of the full declaration. The product may then be shipped with the short form. And one particular that moves from the CRA into the accompanying documents: the end date of the support period, at least with the month and year, to be stated clearly at purchase.
