normakte / Used machinery
A used machine does not automatically need new CE marking. What matters is whether it reaches the EU market for the first time or is substantially modified.
A machine already lawfully placed on the market in the EU can be resold without a new assessment. For the operator, the requirements for the safe use of work equipment continue to apply.
A used machine from outside the EU is made available on the EU market for the first time when imported. It must then comply with the Machinery Regulation like a new one: conformity assessment, technical documentation, declaration, CE marking.
If a used machine is substantially modified, whoever converts it is the manufacturer — for the modified part or for the whole machine.
Passing on a used machine with its original declaration under Directive 2006/42/EC does not change that declaration: it remains the document for the original placing on the market.
Assessment, documents and declaration for import or conversion in one place.
